Terms & Conditions

Please read these terms carefully before using our services.

These Terms and Conditions (Terms) govern your use of the skip bin hire services offered by Jaykay Bin Hire (ABN 47 692 507 010) (we, us, our) and our website at jaykaybinhire.com (Site), and form a binding contractual agreement between us and you.

These Terms are important and should be read carefully. Any questions must be directed to us at info@jaykaybinhire.com.au before engaging our services.

1. Acceptance of Terms

  1. We will provide you with a copy of these Terms and a quote before you engage our services, via the booking checkout page on our Site.
  2. By paying any amount to us in respect of the services, or by instructing us to proceed with the services, you acknowledge that you have read and understood these Terms and agree to be bound by them.
  3. Should you request an increase in the scope of services after receiving a quote, we will provide you with an amended quote in writing via email and you agree to be bound by the amended quote together with these Terms.

2. Variations to Terms

  1. We reserve the right to update and change these Terms from time to time without notice.
  2. You will be subject to the Terms in force at the time when you engage our services, unless agreed otherwise by both parties in writing.

3. Our Services

  1. We offer hire of a range of skip bins (Bins) for waste disposal across Melbourne and surrounding suburbs.
  2. Your hire of a Bin includes delivery and collection of the Bin by us.
  3. Unless subsequently agreed otherwise between the parties in writing, all details of the services to be provided are those selected and purchased at checkout, including:
    1. the duration of the hire, commencing and terminating on the selected delivery date and collection date respectively (Hire Period);
    2. the address of the location where the Bin is to be placed and used during the Hire Period (Project Location);
    3. the specifications of the Bin to be provided to you; and
    4. any extras selected by you, including tyre disposal.
  4. Any extension of the Hire Period is subject to clause 6 (Extended Hire).

4. General Disclaimer

  1. We provide our services on an "as-is" and "as available" basis. While every effort is taken to ensure the accuracy of information on our Site, we make no guarantees regarding currency, suitability, reliability, availability, timeliness or accuracy of that information.
  2. You acknowledge and agree that we, our employees, affiliates and representatives are not responsible for decisions you make, or for any consequences that may flow from your engagement of our services.
  3. Any delivery dates or timelines are provided on an estimated basis only. We make no guarantee that these will be met, as there may be factors beyond our control, and we are not responsible for any delay.
  4. We make no warranty regarding the suitability of our services for any particular purpose, nor do we assume any liability arising out of the use of any service. It is your responsibility to independently determine suitability.

5. Extended Hire

  1. You may request an Extended Hire no later than 1 business day prior to the expiration of the Hire Period by contacting us by phone or text on 0406 814 910 or by email at info@jaykaybinhire.com.au.
  2. You acknowledge that any grant of an Extended Hire is at our sole discretion and subject to availability of our Bins.
  3. If we grant you an Extended Hire, additional fees will become payable for the extended period at the rate of $20 per day (or as otherwise agreed between the parties in writing).
  4. If we are unable to grant an Extended Hire, we will collect the Bin from the Project Location at the end of the Hire Period.
  5. If the Hire Period ceases and you continue to use the Bin, or we are otherwise unable to collect the Bin, additional Extended Hire charges will apply and you agree to pay them.

6. Legal Title

  1. We retain legal and beneficial ownership of the Bin at all times.
  2. Nothing in these Terms should be construed as passing legal or beneficial ownership to you. You agree to maintain the Bin as bailee for us.
  3. Without limiting the generality of this clause, you agree:
    1. not to create or permit any lien, charge or security over the Bin;
    2. not to remove any mark on the Bin which identifies it as being owned by us; and
    3. not to register, or assert any entitlement to register, an interest in the Bin pursuant to the Personal Property Securities Act 2009 (Cth).

7. Your Obligations

  1. During your hire of a Bin, you agree to:
    1. only use the Bin in accordance with all applicable laws, our instructions, and in a safe and reasonable manner;
    2. not place any restricted items inside the Bin, including but not limited to:
      • Asbestos
      • Gas bottles
      • Car batteries
      • Wet pours of concrete touching the bottom or sides of the Bin
      • Food waste
      • Paints, poisons or liquids
      • Paint tins
      • Chemical waste in solid, liquid or powder form
      • Insulation, unless bagged and labelled
      • Any other dangerous goods as defined by the Australian Dangerous Goods Code
    3. not fill the Bin above the level of the sides of the Bin — an overfilled Bin may result in additional charges;
    4. ensure all persons using the Bin are suitably instructed in its safe and proper use;
    5. respond promptly to our communications in relation to the services;
    6. take full responsibility for any misclassification of waste type at checkout, and indemnify us for any additional costs incurred as a result;
    7. keep and maintain the Bin in a good state of repair;
    8. contact us as soon as possible in the event of any accident, incident or damage to the Bin;
    9. where damage to the Bin has been sustained, pay us full compensation for the replacement and/or repair of the Bin;
    10. return the Bin in the same condition as delivered — failure to do so may result in additional charges;
    11. permit and cooperate with our collection of the Bin at the end of the Hire Period;
    12. ensure the Project Location is suitable for the safe delivery, use, storage and collection of the Bin;
    13. where the Bin is placed on a road or public land, reimburse us for the cost of any necessary council permits obtained by us;
    14. allow our representatives to enter the Project Location for the purposes of delivering and retrieving the Bin;
    15. ensure the Bin is not moved once placed at the Project Location until collected by us, unless otherwise agreed in writing;
    16. pay the full amount of the Hire Period even if you do not use the Bin for any or all of the time;
    17. pay all fines and penalties you may incur while using the Bin; and
    18. indemnify us and hold us harmless for all injury or damage caused or contributed to by you.

8. Fees

  1. The fees for our services are as displayed to you at checkout following entry of your booking details.
  2. All fees are in Australian Dollars (AUD) and are inclusive of GST unless indicated otherwise.
  3. We reserve the right to modify, cancel and limit any quote or service at any time.
  4. From time to time, we may offer promotional pricing. Any promotions are confined to the time period and terms as published on our Site.

9. Payments

  1. Full payment is required at the time of booking via our secure online checkout (Stripe). Your Hire Period will not be secured until payment is received in full.
  2. In the event that we receive an invoice for any fines or expenses you incur while using our services, we will issue you with an invoice for those amounts and you agree to pay within 7 days.
  3. Failure to make payment in accordance with these Terms may lead to cancellation or suspension of your hire.
  4. We reserve the right to suspend or terminate any service, at our discretion, if payment is defaulted.

10. Delivery

  1. The Bin will be delivered to the Project Location at the delivery date and time preference selected at checkout, subject to availability.
  2. You acknowledge and agree that:
    1. you must provide us clear, safe and unrestricted access to the Project Location so that the Bin can be delivered;
    2. the person delivering the Bin shall have absolute discretion in selecting a safe place at the Project Location where the Bin may be placed;
    3. if we determine (acting reasonably) that the Project Location cannot be accessed safely, or that the Bin cannot be safely delivered, we may elect to terminate the hire arrangement and retain any amounts paid by you; and
    4. delivery dates and times are estimates only and may be affected by factors beyond our control.
  3. To the extent permitted by law, we exclude any liability for loss or damage caused to your property or the Project Location during delivery or collection by us, except to the extent directly caused by our own negligence.
  4. You must inspect the Bin at the time of delivery and notify us immediately if the Bin is damaged or unfit for use. Failure to do so may result in you being responsible for any damage noted at the end of the Hire Period.

11. Cancellations & Refunds

  1. Either party may terminate the hire by providing the other party a minimum of 24 hours' written notice prior to the scheduled delivery date.
  2. Refunds are not provided unless:
    1. cancellation is received at least 24 hours prior to delivery and no costs have been incurred by us; or
    2. we are in breach of the Australian Consumer Law, as set out in Schedule 2 to the Australian Competition and Consumer Act 2010 (Cth).
  3. Any refund requests will be assessed on a case-by-case basis in accordance with costs already incurred.

12. Liability is Limited

  1. We provide our services on an "as is" basis and without any warranties, representations or conditions of any kind, whether express, implied or statutory, to the extent permitted by law.
  2. We expressly exclude any liability in contract, tort or otherwise for any injury, damage, loss, delay or inconvenience caused directly or indirectly by your use of our services.
  3. Our maximum aggregate liability to you for any loss or damage arising out of or in connection with the supply of our services is limited to the actual charges paid by you in the one-month period preceding the event giving rise to the claim.
  4. The disclaimers, limitations of liability and indemnities within these Terms do not exclude rights that cannot be excluded by law, including rights under the Australian Consumer Law.
  5. We exclude any liability for any special, indirect or consequential loss, including loss of profits, loss of business opportunity or loss of data.

13. Indemnity

  1. You agree to indemnify and hold harmless Jaykay Bin Hire and our officers, agents, directors and employees against any losses, liabilities, costs or expenses arising out of or in connection with:
    1. your use of our services;
    2. damage to the Bin caused or contributed to by you;
    3. any misclassification by you of the relevant waste type at checkout;
    4. any injury or damage caused or contributed to by you;
    5. any breach of these Terms by you, including failure to pay any fees on time; and
    6. the enforcement of these Terms.

14. Intellectual Property

  1. All content on our Site, including text, graphics, logos, images and code, is subject to copyright owned by or licensed to Jaykay Bin Hire.
  2. You may not copy, reproduce, modify or distribute any content from our Site without our prior written permission.
  3. Our trade marks, logos and service marks may not be used without our express written permission.

15. Confidentiality

  1. Each party must keep confidential any information disclosed by the other party that is of a confidential nature, including pricing, business processes and customer details.
  2. Confidentiality obligations do not apply to information that is publicly available, required to be disclosed by law, or disclosed with the consent of the party concerned.
  3. This clause survives termination of these Terms.

16. Force Majeure

  1. We will not be in breach of these Terms or liable to you for any loss resulting from our failure to perform obligations where such failure results from a Force Majeure Event.
  2. Force Majeure Events include, but are not limited to: industrial action, civil unrest, war, fire, flood, natural disaster, epidemic, pandemic, failure of utilities or transport infrastructure, or acts or restrictions of any government agency.
  3. We will notify you in writing as soon as practicable if a Force Majeure Event occurs and will resume performance as soon as reasonably practicable.

17. No Disparagement

  1. You must not make any public or private statement, whether oral or in writing, that is adverse to the reputation or commercial standing of Jaykay Bin Hire, or that is false and has the tendency to damage our reputation, including on any social media platform or review website.

18. Dispute Resolution

  1. If a dispute arises in relation to these Terms, the party claiming the dispute exists must notify the other party in writing of the nature of the dispute.
  2. All notices to us must be sent to info@jaykaybinhire.com.au.
  3. If the dispute is not resolved within 30 business days of the other party receiving the notice, either party may refer the matter to mediation conducted by a mediator agreed between the parties, or as appointed by the Australian Commercial Disputes Centre.
  4. If mediation does not resolve the dispute within 30 business days of appointment of a mediator, either party may commence such legal proceedings as it considers fit.
  5. Despite any dispute, both parties must continue to comply with their obligations under these Terms.
  6. This clause survives termination of these Terms.

19. General

  1. Governing Law. These Terms are governed by the laws of Victoria, Australia. You consent to the exclusive jurisdiction of the courts of Victoria to determine any dispute arising under these Terms.
  2. Severability. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
  3. No Assignment. You cannot transfer or assign your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time, with written notice to you.
  4. Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us and supersede all prior agreements and understandings.
  5. Binding on Successors. These Terms are binding on the parties and their heirs, executors, successors and permitted assigns.
